What are fake files? Lower bit rate files packed into higher bit rate. There are two cases - mp3 files of lower bit rate packed into mp3 files of a higher bit rate, and mp3 (or other lossy formats) packed into FLAC (or APE, etc. lossless codec) container.

Here is an example of the same file downloaded from different services:


You can see that there is even one 95 kbps file (from YouTube) packed into a FLAC container.

So there are 4 fake files out of 9, which are in fact repacked mp3 files.

Among the remaining nominally 'non-mp3' files there is one fake files also originating from mp3, but with noise added to fill the frequency gap (this is done to fool the software for fake files detection).


So the end result in this case is 50/50.

Could people distributing fake files be prosecuted?. No. They sell genuine FLACs, as they advertise, there is no law that says what a FLAC file must contain.

 

These files in brackets (2 (3) (4) are mostly files that have been downloaded twice.
Windows puts brackets with the corresponding numbers for double files (2).

 

No, they are different. They just happen to have the same file names. On the picture attached you can see that they have different bit rates, etc.

I know what you are saying. You do run into people re-encoding a low sample/bit rate file to pass it off as a lossless or higher bit/sample rate file.

This happens quite a bit, even in paid for content and in hardware expansion libs, as sometimes the NEW higher bit rate keyboard just gets the same old libs just up-sampled.

I don't keep a lot of samples or music on my computer but who knows it might be like you say.

 

By scan do you mean you manually discerned what samples were clearly copies of something else you had or did you use a tool for this?(if so, which one?)

Some audio file distributing services boast of hundreds of millions of audio files on their servers.
They simply could not have access, nor had time or resources to get tens of millions of original CDs in order to grab WAVs from them and then compress them into FLAC format.
So they just snatch anything (may be lossy, re-encoded, faulty, damaged, heavily clipped, they do not have time/nerves to check) that comes to their hands on the internet, including free mp3 servers, P2P networks, hubs, torrents, YouTube and the like, and stealing from each other (that's where some of the duplicate file names come from).

They produce fakes by batch converting hundreds of lossy files into FLAC format in a single session, or 'remaster' them by stereotype batch EQ-ing and high and low end harmonics saturation.
All of them are (inevitably) cheaters on the loose.

you do need to also consider the margin of error, faking the funk will assume more lo-fi productions are fake, even if that's the way the originals are
