    so, this is something interesting that came up in my mind:

    if I proclaim I train AI datasets, can I legally steal any copyrighted work I find on the internet, and call it a "fair use", just as all the big tech companies are doing today?

    Yes, as long as the copyright holders put up with it. And that won't take much longer. Then AI trained in this way will be banned in some countries.

    it would be even better, since tech companies keep training on "publicly available data" whatever stolen stuff publicly online is automatically being used for more AI training, frankly AI generated content also to further train AI

    You already said it: “stealing” is theft and “copyright protected” is protected by law. I think stealing is part of the trade but don't get caught.
    I think the law firms and authorities are working flat out to create the legal basis to make it a punishable offense or to protect the author. Of course, the net is not completely free of rights.

    At the latest when the police confiscate your computer, you will know that it was probably illegal and that you as a normal citizen will lose out to the big law firms. Or ask team R2R - they're all wanted too!

    Big Companies, have "Big Lawyers" and "Big Budgets", the average joe has neither and is therefore always a victim forever of those with more power and money,it is the unstated law of this world as it is currently working.

    any angle you can figure out, they have already checkmated.. the only thing the average joe has on his side is he can move fast and work with few resources and leave no footprints of where he has been.

    yo from my understanding, its learning in the same way that all of us artists learn, by analyzing why things are done. like especially when i was a beginner songwriter, i would listen to songs i loved (that were copyrighted) and study them. i wasnt stealing from whoever, i was trying to understand how and why they did things in their arrangements or lyrics, to grow in whatever area of music i was focused on growing in

    there was this quote that really stuck with me by this jazz pianist Bill Evans, it was on some shit like, he doesnt copy what the person is playing; but tries to understand the essence behind their playing. the further down i got on my journey i realized, thats something thats always been done by artists and is important in learning in the arts

    so A.I. learning in the same way, i cant say its stealing by consuming. like someone put a record out for their own reasons and ambitions, i came across one the songs and studied it - i didnt ask their permission to study and learn from the music, essentially training myself in the art form from their work. so i dont see why you wouldnt be able to do that with your A.I. program, especially since from my understanding what it produces from that studying cant be copyrighted anyways

    What are you talking about? Nobody stole anything in this context.
    1. that @tzzsmk is even talking about “stealing” in this context is a distraction. The actual debate is about usage rights, not theft.
    2. fair use means that the reproduction of copyrighted material for educational and scientific purposes does not constitute copyright infringement. In addition, the training of AI datasets involves a transformation, which again speaks in favor of the fair use argument. Of course, there are also arguments against a classification as fair use - for example, the scope of the protected data in relation to the entire work and, above all, the impact of the use on the value of the protected work.

    Piracy is a strange concept, theft of intellectual property stranger, when you realize a digital copy cost virtually nothing to make, so an unathorized copy doesn't cost the company anything, it only inteferes with their revenue stream from licensing, which then gets into a whole ocean of side issues, such as is it really "unique and different" enough to be protected, or is rewritten,reverse engineered code, samples etc. How long should such materials be protected? 1 year,5 years, a lifetime, infinity, how much does IP protection diminish the creative abilities of the common, how much does stifle creation of new products, etc, etc.etc.

    If you're not making money, and not costing any money to the big tech companies, then probably no one's gonna come after you.

    Plus, specifically in my area of work, public available data are completely useless most of the time.

    If you're using copyrighted work as a prompt to generate something new, you're not stealing, since the results are not substantially equal to the source.

    As someone who has been responsible for more strikes by You Tube for copyright infringement than a Philadelphia Philly's pitcher, I'm not one to give advice on that, except

    if my dog munches on a 5 year old kid,am I responsible for it? an the answer is no... sorry, I mean yes!

    so, if I obtain some sample packs (one shots and such) from sister site, to study and learn them (not use them), it's technically legal?
    (Dumbledore from Harry Potter series would love it - "find but not use" was the trickery to obtain Philospher's Stone)

    @tzzsmk : ay fam if youre shaking in your boots about doing time, you can get free legal advice from most lawyers, im not a lawyer yo. i have some experience with copyright laws in the U.S. just from being an artist here, but idk everything, thats why i have lawyers

    though from what i understand, piracy in entertainment is similar to some drug laws here. like if youre trying to distribute shit or get paid, thats when you might catch a case - if youre just using copyrighted material for yourself to learn or to teach (A.I. in this case), it falls under fair use by law. if youre shook about catching a case, definitely seek professional legal advice, im not a lawyer - good luck though

    There's a great book on how the MP3 codec was developed and distributed, that tells the history of limewire, etc - in the final chapter he discusses "The Pirate Party" which was a political party that arose out of these developements (amongs others) and part of their platform was along these lines.

    the book is called "How Music Got Free" - its also available as an audio book which is available ironically enough on better torrents all over the internets..
