    Hi!
I've been sampling old records for years and recently I dig a record where the melody is the same on the part where I want to chop the sample, so I'm asking you guys If I just pitch up/down and stretch the sample to fit the tempo without fliping it does that consider that I sampled the record?
    Thanks

Depends on the context, is it a 4 bar/8bar? are there other elements woven into this one? Is there variation? I would personally consider it not a real flip, but if its an obscure sample and it is woven with lots of other elements, I would be content with saying i "flipped" it.

for example this sample Jeffrey Osborne - Baby I want to sample the first 15 seconds do I need to flip it to say that I sampled beacuse I want to just pitch down and stretch the sample to the tempo and when I sample something I usually add couple more instruments

Agreed, even thinking about it now its an elitist way of thinking thing about flipping, even i was thinking that towards the end of my first response, hence the quote marks :D

No matter how much you tweak it, it's still sampling.

Thanks for all responses, I really have doubts about this somewhere on the internet I read that you must flip it beacuse if just put like a loop pitched up or down, stretched to a certain tempo its not sampling. My friends also told me the same thing you told me

pitching/ reversing/ filtering etc doesn't make a "sample" not a sample. The only way I've got around mechanical copyright of a sample is by re-creating the sample from scratch.

Just going to throw some stuff in here since sampling is quite an old technique however there are still misconceptions such as the '4 second rule'.

Music that is composed/produced has a copyright and it initially belongs to the composer/producer. He/she might grant (sell) these rights to a record label but we'll keep it simple and cut out the record label.

Since the recorded song's copyright belongs to the owner, he/she has all rights as to what can be done to the music.

They own every part of it.

Regardless of whether you pitch-up/down or reverse parts, you are still using parts from the work that belongs to someone else.

This is not allowed legally without consent.

However, if you work with it creatively the person might not notice and you'll get away with it.

As 'remix' said in a previous post, "do whatever you want to do man"! Unless you're making a shit ton of cash off it, record labels probably won't come after you. And definitely don't let it limit your creativity otherwise genres such as hip hop would never have existed.

if the original Artist/Band/Group can recognized it and Cache you...you will have to pay for a clearance it is Better to ask/Contact the group and pay for it first because if you use it and it Blows up and they think you are Making a lot of Money of of it and then you ask them they are going to want a lot of Money then
