I am sorry you dont use Viper anymore, however the license is not transferrable or for reselling, you accepted this in the terms of agreement when you made the purchase:

License
Adam Szabo grants you a revocable, non-exclusive, non-transferable, limited license to download, install and use the Products solely for your personal purposes strictly in accordance with the terms of this Agreement.

Restrictions
You agree not to, and you will not permit others to: license, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or make the Product available to any third party.

I hope you will honor our agreement. If you resell it, the new buyer did not agree to these terms from my site, and he wont be eligible to all the free updates that come with it.

AFAIK, the European Court of Justice decided already in 2012 that the trade in used software is legal and resale cannot be excluded by licence agreements.
And since you, as an Hungarian, belong the the EU, this verdict applies and the passage in question is legally void.

 

The European court does not consider software case by case, they came up with a general law. They can sue me if they wish, however I will defend my terms that I made. The non transferable license is a technical limitation, I could make it transferable but then it would have to be an online activation and then you would be complaining about that. I didnt force anyone to accept MY terms, if they dont agree with it like you do, it is stated then dont buy the product. This person bought the product and accepted my terms. Its that simple.

 

I really love this plugin legit owner here it would be so cool if we could edit wavetables like serum and even have a sample player built in no pressure just an idea

Him being the developer grants him his own terms it’s like hiring a contractor to work on a house they have fees and terms of agreements for the service they provide would you steal a workers truck and drive off with there tools? No then stop complaining and saying it’s unfair life’s unfair get over it
You bought it and accepted the agreement.Shit like this makes me laugh it’s called terms and conditions for a reason this man poured all his effort in an amazing plugin and you wanna just sell it that’s a huge slap in mister szabos face if you ask me

 

No it doesn't, developers, sellers etc have to respect the various laws in the regions they operate in, they cannot make up their own else we'd be in a lot of trouble! Just ask Apple, see how big they are, even they are having to comply! "You need to make USB C standard" - they had no choice!

Thank you for the suggestions, I might consider them, however Viper is meant to be a Virus inspired synth, and that didnt have a sample player or editable wavetables (although you can create your own waveforms and use them in Viper!).

 

To be fair its not No Avenger that bought it, so he can have his opinion, its fine.

 

Still kinda new to it but it sounds amazing especially for the cyberpunk genre are we getting any new updates for it in the coming months?

 

I really dont understand why EVERY TIME there has to be an argument. I am not APPLE, if I would be I would drink cocktails in Hawai for the rest of my life. I am single developer with limited resources, I can only make offline licenses (or do you want me to spend years developing transferable licenses with online activation (just to make EU happy) and if the site/system ever shuts down you will never be able to activate again?), and I have the right to make my own terms. If one does not like it or agree with it or accept thats totally fine, but if one accepts it then one should kindly abide by it.

 

Its only fair to warn others that they not may get stuck on that version forever, but will 100% be stuck with that. Anyway, there is a summer sale on the site at the moment if one wishes to get a discount from the "official" shop for whatever its worth.

 

How about Swatch sells the key and you try to sue them? Because, good luck with that! Your terms of service are legally and more importantly morally wrong.

But anyway, I do not wish to drag this out any further I said what I wanted to say, I explained the reasoning why one cant sell licenses, you may or may not agree with it, I only ask that the person selling consider the agreement that we made when he made the purchase, as a common courtesy. I am also openly warning any 3rd party buyers that since they did not purchase from me they are not my customer and wont get and customer support and free updates. (And no EU law can force me to do that). Its better to purchase from from the official store. In the end its for the buyer to decide if they want a cheaper Viper with no further support, or a legit one with lifetime free updates.

 

Worked in EU court for 25 years. You will loose in a legal battle vs user for a non transferable license as the non Transferable clause in software if inserted in a contract it has no value, but no one will sue you for a 100€ software and that’s the fact.
