    Are Vengeance Construction kits Copyright?

what if I make a tune with one? or part of one?

What is the legal standpoint if it get "signed to a label", or if i "give it away free"?

What are the other considerations with such an odd clause

I'd like to keep the answers to the legal side of things we can debate vengenace and construction kits on another post

    Cheers

    Cheers for the links. .

Yeah you have to give 50% royalties

But how would you approach if you didn't buy it.

I suppose they would only chase you if there was money. .. and they'd look like bad guys. .

But I'm interested on what decides the copyright.

..fx over a melody sample doesn't make it considered mine (according to vengeance)

    It's a grey area. .

to be honest, nobody cares about, ive seen big labels(armada and their sublabels) signing template tracks and construction tracks, so i guess vegeance doesnt have the overview to check out all of these releases to find a track which was made with their construction kits.

anyway its still big BS in my opinion to try to sign a template or a construction kit track and it shows zero creativity and skills from the producer/artists and its a shame for the industry. :(

    PS:
another point is that nobody actual respects the Vengeance Copyright Policy  , if you look close, you cant use any samples from the Sample CD Line when you have not bought it, but look the whole EDM scane is using them, every bedroom producer and it made Vengeance still big.

so i doubt they will always do anything about the whole story.

I think the wording is pretty clear, you can use the single shot samples for commercial use, but not the melodies and music loops, unless you chop them up and process them to a point where they don't resemble the original. It's really impossible to implement copyright laws when it comes to these things, I mean imagine if they were to say that the single shot samples are under copyright and that you can't use them for commercial releases, how is anyone supposed to know? They can't.

    Hello,

I've studied some of the legal side in music business (not studying a lawyer but copyright was part of my course).

As you mentioned: "All melodies, melodic loops and compositions are licenced for non-commercial use only".

These are creative parts that they have composed themselves (legally you compose music even if it's EDM. 'Producer' is not actually the correct 'official' term) and the copyright would belong to them. Quite a dick move on their behalf since they know that people will be using it; maybe a dick strategy to start a law suit once a song goes big. Before someone says "Too much trouble to grant every person a copyright legally", they could have followed one of the Creative Commons rights.

The same thing goes with those vocal packs. In fact, when registering your some with collection agencies you have to credit their songwriter which is usually detailed in a text file within the folder of the sample pack.

As a poster above mentioned, stick to the drum hits (which usually aren't even theirs to begin with and sampled from another song) as it's quite hard to sue someone over it (it has been done before though). If you use the vocals, chop them up so you aren't using their lyrics or vocal melodies.

As my one lecturer said, the best way to avoid it is to only use your own material.

So avoid melodies and lyrics, and layer those drum hits so it's not an exact copy.
