FREE, I haven't checked these samples, but Free Slate Digital..seems like a party going on

The sample packs are basically aimed at wannabee's producers: they can start creating songs with them, study how to create structures and show off the final product with their friends. Speaking of commercial productions, however, the sample packs are completely out of question: no label manager would accept any artistic product created with them, it is too risky.
The problems arising from their use are 3:

    • In general, any sample contained in a song must undergo a clearance process, avoiding this procedure can lead to copyright problems and legal battles, especially when the song is successful and begins to generate income. Just reading on the website "100% royality free" is not indicative of anything: it is their policy that matters
6.1 Slate Rights. As between the parties, Slate and its Third Party Licensors own all right, title and interest in and to the Service, including, without limitation, all samples, sounds, audio files, and compositions, proprietary processes and technologies relating thereto, and all intellectual property rights therein, including, without limitation, all modifications, updates and derivative works relating to the Service
    • In case the samples used in the track are actually royality free, then the song can be replicated by any other producer without you having any income (with consequent economic loss)
    • Platform algorithms: the song produced can be recognized by youtube, soundcloud etc. as owned by someone else who has used the samples before you, which means that the song will be demonetized
No, I don't really think that using sample packs for commercial productions is a good idea, but everyone is free to do what they want and then pay the consequences.

    topic turns into a bullshit.

All this free samples are royalty free. It means that you are allow to use it in your production for commercial purpose. You are allow to modify it, or use as is. You are not allow to resell this samples. SAMPLES.

FYI you are not allow to use omnisphere for beat production. Only for YOUR OWN complete songs. No one was stopped by this.

Don't get confused: free download doesn't necessarily mean royalty free.

Some sample packs are really 100% royality free (a few), others are not (like these from Slate), others are royalty free until the song is bought by a major or exceeds 1 million downloads. All this informations are contained in the agreement attached to the samples, which I recommend reading carefully.

Using sample packs indiscriminately without knowing what you can run into is reckless, if the song is successful (this is difficult to establish it at first) then you can find yourself in an unpleasant position: demonetized videos, copyright issues, legal problems , lawyers, court, etc.

I still think that sample packs should never be used for productions, I often use them as inspiration, but then I play everything from scratch, obtaining a totally different result

@recycle, I agree with a lot of what you wrote - like the necessity to read carefully every EULA and other legal conditions that you accept, even (or especially) when downloading "free" samples. But there are some things I don't get
Let me understand. Are you saying that if you and me both throw the same (let's say "royalty free") flute sample (not a melody loop) into a sampler and I come up with a catchy melody and the product (song) becomes a hit, you can simply replicate(?) the whole song, including the melody (pitch, rhythm,..), because you obviously own the same rights to use that one note sample?

You better change your attitude Mr DanierFaraday, I'm trying to deepen the subject, at the moment you're just trying to troll
Ok, I’ll copypaste the Slate policy for the 3rd time, pay attention to the tern “derivative works”:

Meaning: Slate own the right of any composition you’ll create with those samples

What they write on the website to advertise the product “100% royalty free” is only marketing and has no legal value, what matters is the policy

How can you read and misunderstood everything. 6.1 Slate Rights.... means that you can't resell samples/plugins/technologies under your name. Life is hard. I submit a ticket to support. Will post answer here. Will see who's trolling.

To be more precise, I'm talking about the use of loops: for example chord progressions or melodic themes or very characterized drumbeats: if the loop in question is royality free then I can use it too (and hundreds of other producers too) . In case the track becomes a hit at that point hundreds of clone songs will pop out with that loop, but you will not perceive any royality from them.

    Even that's not 100% true

If you only use the synth not the Samples of Omnisphere it's ok

I wrote with the support around 1-2 Years ago about a similar topic

    " Hello ...
    Thank you for reaching out.

Since you are working on an indie game that sounds like it’s a smaller project, I don’t think the non-traditional license route is appropriate.

Admittedly, those are very specific cases that usually involve studios and rarely come to pass.

Keep in mind, you can still use Omnisphere’s Synth Mode to create your own SFX, it is only the soundsources that are off limits.

    Hope this helps!

    Best,..."

Amazing. Let me remind you that the reason why ppl buying omsphere is it's actual soundsource library. Because there are a lot of better choices for subtractive, fm and resampling needs. So that was true on 100%. Because literally no one will program subdrop or riser with omnisphere (because it's a pain to program something in it) when you have fm8, sylenth, avenger, falcon, vital and serum.

    except me :winker:
... oh and I bought it for that reason

maybe I'm the only one , but I don't know

I would say the exact same thing about FM8
for me this one of the complexes synths there is

Omnispere is one of the easier Synths to program in for me
everything is simple, right click for modulations
on the Matrix page, you can look what's happening
and it has also a visual feedback, not the best but not the worst I have ever seen .

For the rest of your list I would agree (abstention on sylenth because I don't worked with newer Versions of it )
