    hi all :) , lets suppose you made a track, your happy with this track :) suddenly appear someone and say you stole melody from me !! what can you do in this situation, and you notice that he's right

    If it is coincedence and there's no money at stake, have a nice cup of tea and enjoy the melody. If there's interests at stake, let the oposing party prove they came up with it first somehow. If they can, cut a deal or take it down. Then there's many factors like the sound, is it the hook, same key etc. I wouldn't worry about it. Nothing new under the sun ... :wink:

    If only the melody is similar then don't even bother
    If you also copied samples, some parts, structure, and, I'd say 70% of their song, then I'm afraid but this may start to be called "stealing"

    There's no real line that separates getting inspiration and stealing honestly. And there's A LOT of factors like artwerkski said above. Don't even bother unless it's clearly obvious you copied.

  8. As a general rule of thumb, if the artist gives you grief, don't sweat it. If their management gives you grief, get a manager, a lawyer or an apology ready.

The company is now seeking $800,000 in restitution after winning their copyright infringement case against Michael Skidmore, the trustee of Spirit band member Rande Wolfe. The fees include $613,471 in attorney’s fees, with the rest of the costs coming from experts and witnesses.

    Well, did you copy the melody on purpose of not? Did you publish your track and have you made money with it?
    If his track wasn't commercially published, there's nothing to worry about. You could even confirm you did steal, because you like the melody.
    If his track was commercially published with a big label, you could run into problems, and try to come to a solution.

    A melody alone does not make a song. There are only twelve tones, so for sure every combination has already been used somewhere, sometime. It is a matter of how similar the songs are, not individual progressions out of context. If it were the case, U2 would earn additional millions by just sueing everyone that uses "their" With Or Without You bassline...

    EDIT: Actually, I would earn millions. I used that very same bass sequence years before U2...

    Melody and lyrics, the two things you can't copy.
    You can copy harmony but only if you write a new melody on top. This is contrafact. "Borrowing chord progressions" not to say it couldn't get you in trouble.

    That's certainly a funny way to look at it since melody is the one thing you can't copy and sample copyright belongs to the original artist/copyright holder of the sample.

    Take the case of Rune Lindbaek vs Royksopp for example. One of the things Rune accused (sued) Royksopp of stealing was "his" idea of using a particular sample. He lost.
