There are some manufacterures that sell sample packs with terms in their license agreement:

You may NOT do the following (including without limitation):

(1) A single Sound may not appear or resound on its own in any music production; Sounds may solely be used such that a number of different Sounds are piled on each other (layers).

Can someone explain this further? Is it allowed to recreate the chords/melodie and use your own instrument/VST instead?

What If I put i.e. a single note sine wave through my whole track and use Ueberschall's samples on top, is it then layered?

What happens if I use the samples without the rules of the license agreement? Can they sue me? Will I have to pay royalties?

(I buy all the samples I want to use)

I think it means, you cannot use the samples in such a way that they can be cut out of your track and re-made into a new sample that can be made into a library that sounds the same as the original. As long as it doesn't sound like the pure sample from the pack, it's ok.

 

Just dont make samples pack with their samples...
You had pay your part of "royalties" when you buy the pack itself so, you can use it in your music production as you want.

They dont will chase you, stay easy...

 

It is just here to avoid resampling. No problem at all.
