robin "thicke", now I understand

still it would be nice to see what they actually got from sony and robin's management company

 

"win" and "settled" are completely different things....
the case was weak to begin with. the whole case was based on a quote that robin thicke made the song was inspired by marvin gaye and he wanted to make a song that had the "feel" he had..
almost every song is inspired by something, that doesnt make it a copyright case

if robin had taken this to court he would have won if he had a competent lawyer

 

You have to bear in mind that a judge and jury are not going to be musically "intelligent" when it comes to these matters. So in court when they hear Robin Thicke felt "inspired" by the Marvin Gaye song they're going to read that as "stolen", not borrowed or sparking an idea. The smoking gun are Thicke's very own words, and the very fact that he's coined a few million dollars or whatever amount from it being a world-wide hit.

That's why a lot of these cases are settled out of court. For one thing it's less money than it would have been with court costs, secondly it just sweeps the whole shoddy story under the carpet so Robin Thicke can continue looking like a cool dude and we'll forget he stole that Marvin Gaye song, as every music-minded person knows he DID.

 

Bad precedence for the industry... makes them look weak... I wonder why they didnt just throw money at the issue or lawyer them into oblivion... You have to figure that the Gaye estate isn't completely liquid at this point... The songs sound similar, but there are tons of songs that have much more in common than what they're alleging... I think his company could have won this in court; too bad they pussed out... Not that I like seeing the "big guys" win, just wondering why they gave up so easily...

They went after everyone... T.I, R.T., Pharrell, Sony, and EMI April... for not keeping Blurred Lines from becoming a hit; apparently its EMI April's job to protect Marvin's rights as well as R.T's...

 

Because his name was being served on the papers - he was the one being sued, not Williams. Robin Thicke is the artist, one third of the writers, the person who made the "inspired by Marvin Gaye" comment. Oh and he's also white (but maybe we shouldn't go there).

It's the estate of Marvin Gaye vs Robin Thicke, and that's it. That's why. Pharrell Williams might have been the one getting sued if he'd actually been all those same things qualifying him as the guilty party. The lawyers would have got nowhere trying to sue Williams, unless perhaps he'd openly come out with "yeah I just sampled Marvin Gaye and copied every note exactly the same. Who gives a fuck". Even then it's still not the golden nugget of the artist himself, the one that's in the spotlight doing stupid twerking with Miley Cyrus. Now that does deserve punishment....

congrats to the gaye estate. i don't care what nobody says, blurred lines uses Got to Give It Up in some manner. pharrell and quest love got some fucking nerve because if i took happy, made a song and changed the melody to d minor and changed the last note in the chord progression he would sue my ass. gtfoh

 

cases like this need judges that have a clue musically. The melodies and notes in these 2 songs are completely different. There was no infringement here at all.
