Need a US East Coast Resident's help

    Hello,

    I'm a french student who buys a lot on the web without any problem cause i'm careful.

    I explain quickly my problem :

    last year in December 2012, i purchased a Dj mixer (Pioneer djm 850k) on an ebay shop called INFINITI ELECTRONICS, it was looking like very professionnal, with a lot nice comments about it and i even ask to people who comments (Australians, Polish and French) how it really was in the facts. They answered me there was no problem with this serious shop.

    So i bought the brandnew djm 850 mixer for christmas, received it without any problem, but when i tried it, he has a malfunction (the usb card was over..) So i decided to send back the product as the guys of the shop told me to do.

    It was decided that they should fix it or replace it, and that the beginning of the worries.

    Since they received it in February 2013 ( i've led an investigation with the french postal services and i've got the USPS receipt which say the item has been received by Mr-Mike in New-York)

    Each week i call them an they just have a good ride with me..that i will get update soon etc... BUT i still have not my mixer back, and no refund too..

    So i don't have too much hope now and i think i've lost more than 1400 $ on this trade but i would like to try a last thing before give up


    If a us resident or a New-York inhabitant would help me to get back my money (1380 $), i could let him 500 $ for the help.

    i think i've got all the proof but as i live in europe it's not easy to lead this shop in justice ( i have the paypal transaction number, ebay item number, both USPS and French postal items numbers when i sent back the item to the shop, and the USPS receipt with the signature of the guy meaning they've well received my malfunctionning item)

    Just a question have you check French customs?
    Normally when things come from out of the European Union they have to go trough customs, sometime it can get stuck there mainly when it is electronics and then you have to pay some customs fees to get it.

    Sorry to hear this!

    I do live here, but not sure how I would be able to help you. Also it's in Bushwick which can be a pretty bad part of town (although many hipsters have migrated there)

    The address seems to be someone's house (google map street view)

    Are there any legal options?

    try ebay/paypal first. if they can't help you, then call your credit card company.

    +1 eBay/PayPal - definitely PayPal as the transaction would have been covered for that high amount. Although you purchased in December 2012 - I'm not sure now that we're in September 2013 how you're covered, being 10 months after the fact... but you should definitely try right now before it gets any later. The best thing on your side is his signature to say he received it. That's the key in all of this, but he could have easily closed his "store" (his house) and moved on.

    Also! Try BBB - they handle disagreements between businesses and their customers. They are based in the U.S. and can complain to the business on your behalf.

    Mike obviously thinks he can play some silly game with you, as you're in France and he's in the U.S. - he thinks he's above the law. Well, he's wrong. As a retail trader he has to abide by the state law which holds him accountable and they will defend paying customers, no matter where in the world they reside.

    I really hope you get your money back from him or at least get some working DJ equipment. Good luck!!

    Ya, thzt sucks bad man. Number one, don't buy new stuff on ebay. Why wouldnt you just order from a legit website with rock solid return policy. Number two, you are extremely patient! I would have never waited that long to complain. If my shit doesnt work I would want a replacement or refund that day! That is the advantage of big websites! Customer service and guarantees!

    All that aside I do live in florida and would go beat that guy up for you, but NY is kinda far!

    Your best bet is to battle it through ebay and paypal, but that might be hard since you waited almost a year. Next time demand a replacement or refund that day. What is Mike fixing it himself? I doubt it. Sales companies never fix their own shit, it gets sent back to factory and sales company supposed to just send another one. This is why I am not a fan of ebay. You have to dispute it instead of a big website will just exchange or refund it no questions asked.

    So good luck to you, the only way I see you getting that money back is a long battle with ebay and paypal. Or if you went to Mike's house and beat it out of him!

    I don't Know how paypal/ebay would work on this mainly because it has ben almost a year, and it was a "replace service" by the "store" and that took place out of the paypal and ebay services.

    I'm just going to leave a coople sites that you can order stuff next time so you don't run into to this tipe of problems

    One last thing - you may think the lower prices in the U.S. are irresistible to us Europeans BUT, as I have found out, the customs office in your country will just make you pay something like 20 - 25% of the U.S. price for local import tax duty. So you could easily end up saving almost nothing, compared with the same item on offer for a "higher price" in France, Germany, UK etc. It's only if you were actually going to the U.S. and bringing it back by yourself then you don't have to worry about paying customs tax (unless you're bringing back lots of big boxes, then you'll be asked a few questions). Still, let us know how it goes with this.

    What you told him was so garbled that not only was it badly written with the poorest grammar but he'd already clearly explained his item wasn't "stuck in customs". It's "stuck" in a store in New York, hence the obvious title of his post. If you were literate enough to take his full story on board then you may have understood better. Anyway you get 1 star for trying, ok? Good boy.

    That comment coming from a user with the username "London007" shouldn't surprise me right?
    I mean You clearly think that the whole world writes and speaks English, you don't even consider that exists other country that don't teach English as first or second language.
    You should take your head out of you egocentric ass because I quoted your post just to kinda of explain what I said before, not to criticize, disagree or lower its value in any shape or form.
    I would like to see you learn my language just by hearing music watching movies and surfing online...
    By the way I also talk and write Spanish and a little bit of french.
    I din't stayed just by learning my native language...

    It's cool rflip I think we all need to be a little more understanding on a forum where people from all over the earth congregate. I've met some amazing people here that maybe didn't speak perfect English but they were fluent in the stuff that mattered.

    i've just seen all your comments and whatever you said or advised me, i really appreciate this help. Bringing your brick on the wall brings me some heat to the heart

    I just want to be clearer as i can cause my english is far to be fluent, i work on it the more i can in order to progress so i'll hope you'll understand and don't bash me Mr.Bond

    -Off-topic : Rflip speaks well english to my eyes ! a lot better than me so it appeared to me a really sterile problem, useless agressivity - and that's why i prevent for myself above^^-


    Thus i think i've understood the most part of all your posts so keep cool because even the "garbled" sentences were enough clear to me.

    So i can confirm the fees have been paid as the item has been received on february by this Mr.Mike..

    Concerning Ebay and paypal, of course i called them several times but the thing is that the 45 days limit has been exeeded for a long time now. ( it's fast when you think to the shipping delays of common postal services)

    Finally i know that the customs fees make the purchases in U.S by internet less interesting than a quick overview on the price could let it think but sometimes it still cheaper.

    I buy most of my gear on woodbrass but i don't like this french website, i prefer thomann cause i've always got great communication with them, fast shipping way and they often offer the best prices for low budget like those i have ( this djm was the most expensive gear of my short life ! )

    Anyway, the next time i'll buy to the US, it will be on a real shop, not on a ebay store. Now i've understood it's not really safe although i've bought many things with no problem at all.
    I'll try too to get in touch with the BBB Online Complaint System and with the Bushwick Mobile Sound to see if i can learn more.
