    Just out of curiosity......where is this song going that you plan to sample?Is it a major release?Is it something you plan to upload to Soundclound?If so how many followers do you have?How many plays?

    ZERO from another recording, as much as you like from your own record.
    That means if you play the melody you want you have absolutely no problem by changing 1 note or root key.

    I asked those questions because i see dudes ask your original question all the time.The thing is,they're uploading the track to Soundclound and have 4 tracks,8 followers and 15 plays.To be paranoid about lawsuits is ridiculous when you should just be worried about making music.Just my opinion though.

    @Soul1975 I don't have money to spend on lawyers so I have opted to go legal form the start in order to avoid legal consequences. Whether I have one or a million followers my business plan remains the same. Thanks for explaining

    That is known in the industry as sample replay. It is always an option. Just remember that you still have a mechanical copyright license in place and the publishing rights controller has the option to refuse the granting of such license.

    Which is kind of my point.Look,i get it,do it the legal way that's fine and dandy but MAJOR labels are not checking for minor artist with very few plays.If and when you are getting notices for copyright infringement from record sales,pretty good chance you can afford those lawyer fees or can get the sample cleared.

    Also,look up interpolation.

    Always get clearance from both the writers (lyrics and Music) and the owners of the copyright to the recording itself. Then you can never go wrong. I've only ever been turned down once when requesting clearance for short'ish samples... (less than 10 secs of loops or up to 15 sec in a one shot sample.) Most copyright holders simply want credit for their work... and little else unless you want to cover their whole work or a large portion of it.

    It's stupid to think that you can use a sample of 10, 20 or 30 seconds without permission from the owner.
    In Europe or anywhere else, it's not legal !!!

    there is only one solution: people do not recognize the sample you used.
    For that you can Pitch it,Transpose it, accelerate, slow down, reverse it, time stretch it, cut it, mix it, and use all the processing that you want.
    the only limit, your imagination :guru:

    Changing a note of the melody is not enough.

    Ask to Robin Thicke & Pharell Williams (they gave 50% of all the net income of "Blurred Lines" to Marvin Gaye Family), Gotye, The Verve, Daft Punk, Bruno Mars, Cold Play, Shakira .... they will tell you how many notes they copied... and how much it costs :rofl:
