Should I register a trademark for my band name?

    Finally, I release my song online with my band name, but not my real name. In this case, should I register a trademark? I read an article about Ultimate Warrior, and it sounds like I may need to do it. Or is it ok to leave it alone?

    If a client ask me that question my answer is the same each and every time: YES, do it now, do not wait until later.

    I always answer in the positive for the following 5 reasons:
    1. It is implicit proof of validity under the Lanham Act.
    2. It affords you national protection and presumption of national ownership instead of just local protection.
    3. It serves as a nationwide deterrent against potential infringement.
    4. It affords you the ability to sue in federal court instead of seeking relief in a state court.
    5. It affords you the ability to request enforcement by Customs and Border Patrol against foreign and domestic companies.
